GENERAL TERMS AND CONDITIONS OF SALE AND USE OF THE E-CARD GIFT SERVICE
Definitions
MERCHANT: refers to the Bobbies company that sells an E-CARD GIFT VOUCHER. PARTICIPANT: refers to an individual who participates financially, in whole or in part, in the purchase of an E-CARD GIFT VOUCHER. INITIATOR: refers to the first PURCHASER of the E-CARD GIFT VOUCHER.
PERSONAL DATA: refers to the list of users' surnames, first names, postal addresses, e-mail addresses, birthdates and titles.
E-CARD GIFT VOUCHER: refers to a prepaid account on the MERCHANT's site. A single code is associated with each E-CARD GIFT VOUCHER. This prepaid account is domiciled on the MERCHANT's bank account and constitutes an advance to benefit the GIFT VOUCHER holder for any order placed with the MERCHANT.
GIFT VOUCHER: refers to the electronic support associated with the E-CARD GIFT VOUCHER on which a single code appears.
BENEFICIARY: refers to the actual person who has the GIFT VOUCHER.
SITE: interface accessible on the Internet, enabling an Internet user to purchase an E-CARD GIFT VOUCHER.
1 - Range
The present terms and conditions govern the sale and use of E-CARD GIFT VOUCHERS. Use of the service implies acceptance of these terms and conditions of use. If you are a minor, you may use the E-CARD GIFT VOUCHER service only with the consent of your parents (or guardians). If any of the terms and conditions of this agreement are found to be invalid, the entire agreement and all other terms and conditions will remain applicable. The MERCHANT reserves the right to make changes to the conditions of these terms of use. You will be able to read these changes on the SITE (refer to the link in the footer). Any use of the service after modification of the conditions of use implies a full acceptance of the new version of the Conditions of Use.
2 - General description of the service provided
The main function of this service is to enable a person to purchase an E-CARD GIFT VOUCHER online. The purchase can be made by a single person (a simple purchase). The main functions are listed below, but are not exhaustive: 1.Possibility for the INITIATOR to print the GIFT VOUCHER 2.The BENEFICIARY can use the GIFT VOUCHER to make purchases from the MERCHANT.
3 - Issuing and sending the E-CARD GIFT VOUCHER
Once the E-CARD GIFT VOUCHER has been finalized, it is issued in the form of a GIFT VOUCHER and sent by e-mail to the INITIATOR. The GIFT VOUCHER cannot be received in the following cases:
1.The e-mail anti-spam filter has blocked the attachment or redirected the message to the "SPAM" or "junk mail" folder.
2.The firewall has blocked the message or attachment.
3.The inbox has reached its size limit.
4.The email address is not valid
4 - Transmission of the E-CARD GIFT VOUCHER to a BENEFICIARY
When an E-CARD GIFT VOUCHER is purchased, ownership is transferred from the MERCHANT to the INITIATOR at the time the GIFT VOUCHER is issued. The INITIATOR is entirely responsible for transferring and transmitting the GIFT VOUCHER to a BENEFICIARY, meaning a third party of his choice. The use of the GIFT VOUCHER as a means of payment is based on the use of a code printed on the GIFT VOUCHER. The code and GIFT VOUCHER must be kept secret by the INITIATOR. The MERCHANT cannot be held responsible in the event of the BENEFICIARY's error, loss of the support with its code or a fraudulent use of this code. Also, as soon as the INITIATOR transfers the E-CARD GIFT VOUCHER to a BENEFICIARY, the latter is automatically deemed to accept the transfer and conditions of sale of the E-CARD GIFT VOUCHER that is specified on the support.
5 - Period of validity of the E-CARD GIFT VOUCHER
E-CARD GIFT VOUCHERS are valid for 365 days. After this period, the E-CARD GIFT VOUCHER will have expired and the unused balance be lost. The expiration date is shown on the GIFT VOUCHER.
6 - Use of the E-CARD GIFT VOUCHER by a BENEFICIARY
The use of the E-CARD GIFT VOUCHER as a means of payment is based on the use of a code printed on the corresponding GIFT VOUCHER. The BENEFICIARY undertakes to take all appropriate measures to ensure the security and confidentiality of this code. The MERCHANT may not be held responsible in the event of a loss of the support containing the code or a fraudulent use of the code. In the event that the electronic support for the GIFT VOUCHER is lost, the BENEFICIARY must contact the INITIATOR to obtain a new electronic copy. If the INITIATOR has himself lost the electronic support (following the deletion, for example, of the e-mail message containing it, the INITIATOR may receive an electronic copy by making a request via the contact link in the SITE footer. In this case, the electronic copy will be sent to the INITATOR's e-mail address originally used to purchase it. Under no circumstances is it possible to obtain a reissue of the GIFT VOUCHER, meaning a new code. The General Terms and Conditions of Sale defined by the MERCHANT and the associated guarantees apply automatically to purchases made using the balance available on the E-CARD GIFT VOUCHER.
Also:
1.The E-CARD GIFT VOUCHER can be used on the MERCHANT's entire website and in official boutiques.
2.If the balance of the E-CARD GIFT VOUCHER is insufficient to cover an online order, an additional payment will be requested during the purchase to finalize the order.
3.The E-CARD GIFT VOUCHER can be used in several installments. If, after an order, a balance remains on the E-CARD GIFT VOUCHER, this balance is valid for any subsequent order, within the limit of the validity date of the E-CARD GIFT VOUCHER indicated on the support.
4.If, after an order has been paid for online with an E-CARD GIFT VOUCHER, the items are returned or the order is cancelled, the E-CARD GIFT VOUCHER used for payment will be re-credited and can then be used for a new purchase. If another means of payment was used in addition to an E-CARD GIFT VOUCHER, the refund will be made in priority on the E-CARD GIFT VOUCHER up to the amount of the initial credit.
7 - Cancellation and refund of an E-CARD GIFT VOUCHER
GIFT VOUCHERS cannot be reimbursed, resold or transferred for a compensation or exchanged for cash.
8 - Violation of these regulations - suspension of service
We may refuse to provide our services to you for any of the following reasons:
1. a violation of these rules
2. we believe that your actions may result in a financial loss to us, harm to us or to a third party
3. changes are being made to the SITE that render it temporarily unusable.
9 - Prices
The amounts of E-CARD GIFT VOUCHERS available for purchase are shown on the SITE.
10 - Applicable jurisdiction
You consent to French jurisdiction for the resolution of any disputes.
